As ride-sharing companies like Uber or Lyft have become more popular, so has the chance of serious injuries or deaths caused by car accidents as a driver or as a passenger.
There are several scenarios of injuries or deaths caused by Uber or Lyft accidents:
1) If you’ve been injured as a passenger in an Uber or Lyft, and the Uber/Lyft driver was “on the clock” meaning they had their app on, and it was the Uber/Lyft driver’s fault, then you are covered by the Uber or Lyft’s third-party liability insurance. This coverage pays up to $1 million for personal injuries and $100,000 in property damage per accident.
2) If you’ve been injured as a passenger in an Uber or Lyft, and the Uber/Lyft driver was “on the clock”, and it was the other driver’s fault, then your injuries are covered by the other driver’s insurance. However, if they do not have insurance or is not enough to cover your injuries, then Uber or Lyft’s underinsured/uninsured insurance coverage will cover your injuries up to $1 million.
3) If you’ve been injured as a passenger in an Uber or Lyft, and the Uber/Lyft driver did not have their app on, then the driver’s personal car insurance will be the only coverage for your injuries.
4) If you were active on the clock as a driver of Uber or Lyft and injured in an accident that was not your fault, then your injuries are covered by the other driver’s insurance, and if they do not have insurance or is not enough to cover your injuries, then the Uber or Lyft underinsured/uninsured insurance coverage will cover your injuries up to $1 million.
O.C.G.A. § 33-1-24
